Section 203(b)(5) of the Immigration and Nationality Act (INA) has opened up a new opportunity for foreign individuals to obtain temporary permanent resident status in the United States. The EB-5 Visa will grant the foreign investor, his/her spouse, immediate family members, and children under 21 years of age conditional permanent residency (Green Card) for 2 years. The U.S. Citizenship and Immigration Services’ Immigrant Investor Program created two investment options for foreign individuals to obtain EB-5 Visas; the foreign individual may either invest $1,000,000 in a single commercial venture or at least $500,000 in a “regional center” or “targeted employment area” which the state defines as either a high unemployment or rural area. The investment will need to support a minimal of 10 full-time jobs for United States workers with a 2 year period. These jobs include direct and indirect jobs that arise from the original investment. Investors must also demonstrate “commitment of capital,” meaning that they must have the actual monetary funds available for investment.
